‍Service Agreement

By ordering services from Brudson Virtual Tours (henceforth referred to as “BVT”) you agree to the following service agreement. We trust this is helpful and simple to understand as we begin working together.

BVT is an independent contractor and not an employee of the Client.

BVT will provide the 3D Matterport Virtual Tour, photography and floorplan creation the Client specifies.

We will perform the Services you order within a timeframe we specify prior to beginning. Services are performed at our then-current rates as posted on our website and may be updated without notice. Requests from your online order will be considered formal Service Requests and we shall confirm such requests via the email address provided in the submission.

We will pay to host the final version of the 3D Matterport Virtual Tour for 2 months (60 days) at no additional cost to the Client. If the Client wishes to continue having the virtual tour hosted longer, the Client will need to notify us via email and pay our then-current hosting fee (currently £5 per month, October 2021) by direct debit using our payment provider, Stripe. Please note, all “Matterport Spaces” and 3D models are hosted directly with Matterport Inc. “Matterport” and not with BVT directly. We are not responsible for any changes the hosting provider makes.

Subject to the terms of this agreement, BVT will use commercially reasonable efforts to provide the Services and to comply with all applicable laws and regulations in fulfilling its obligations and providing Services under this agreement and any additional orders.

Images are delivered to the “licensee” for:

• The purpose of listing a property for sale/rent

Or

• The purpose of advertising the “business” on Clients own website, BVT website and/or Google Maps Street View
• For image integrity and quality control, images are not to be altered or edited once delivered. Editing will be done prior to delivery by BVT.

Copyright

• The copyright remains that of the photographer who captured the image(s).

Floorplans

• Interactive floorplans, Interactive Site Plans, and Schematic Floorplans are for illustrative purposes only and are to be used as a guide. Measurements are calculated using “gross internal area”. The Client and/or Buyer is to verify measurements.

Day Of Virtual Tour

• Property/Business should be “camera-ready” - please download our checklist at https://brudsonvirtual.tours/docs
• BVT will not be liable for cleaning, dusting, or moving furniture
• The Client will ensure the area is safe to conduct our Services and are no hazards preventing us from doing so
• We will try our best to work with pets however we are not responsible for them. If pets will be an issue please let us know when booking the tour
• Our virtual tour service covers the entire property - lofts are not included.

Cancellations

• A virtual tour can be cancelled/rescheduled at no extra cost if given at least 24 hours notice
• Once we arrive at a property, orders can be cancelled but no refunds will be given
• Hosting cancellations can be made via email and in 30 days advance notice

Weather

• On some occasions, we may not be able to provide our best work due to the weather. The decision on whether to reschedule is up to the Client.
• No charges for rescheduling due to weather if the photographer has travelled less than 15 miles

Payments

• Payments are taken through our payment provider “Stripe” either on our own website or Stripes hosted page
• For subscription payments will be taken by direct debit through our payment provider “Stripe”

Miscellaneous

• If our services are used to acquire the layout of a property, business or any scanned property, BVT will not be held liable for any action or theft resulting from our services. The virtual tours are posted online and can be viewed by anyone from anywhere.
